WHAT IS THE WHEELER:

The Wheeler Opera House (“the Wheeler”) is owned and operated by the City of Aspen a home rule municipality. The Wheeler Opera House’s mission is connecting community through the arts and welcoming audiences to come be a part of the history of Aspen. The Wheeler Opera House is located at 320 E Hyman Ave, Aspen, CO 81611.

WHY HAS THE WHEELER INSTITUTED THIS PRIVACY POLICY:

The Wheeler Opera House has created this Privacy Policy (“Policy”) to describe the types of information the Wheeler may collect from you or that you may provide when you visit the Wheeler’s websites located at wheeleroperahouse.com and aspenshowtix.com (“the Wheeler’s websites”). This policy details the Wheeler’s practices for collecting, using, maintaining, protecting, and disclosing that information. This Policy applies to all information the Wheeler collects, including without limitation, the following:

  • On wheeleroperahouse.com and aspenshowtix.com.
  • In email, text, and other electronic messages between you and the Wheeler’s websites.

It does not apply to information collected by the Wheeler offline or through any other means or by any third party.

Please read this Policy carefully to understand the Wheeler’s policies and practices regarding your information and how the Wheeler will treat it. If you do not agree with the Wheeler’s policies and practices, your choice is not to use the Wheeler’s websites, and alternatively receive information and purchase tickets at the Wheeler Opera House. By accessing or using the Wheeler’s websites, you agree to this Privacy Policy. This Policy may change from time to time (see “Changes to the Wheeler’s Policy” section below). Your continued use of the Wheeler’s Websites after the Wheeler makes changes to the Privacy Policy will be deemed to be acceptance of those changes, so please check the policy periodically for updates.

WHERE THIS POLICY APPLIES:

The Wheelers websites are hosted in and provided from the United States, and your use of the Wheeler’s website is governed by United States law. If you are using the Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where the Wheeler’s systems and facilities, and those of the Wheeler’s third-party providers and recipients of information, are located. The data protection and other laws of the United States and other countries might be different than those in your country. By using the Wheeler’s websites, you consent to your information being transferred to the Wheeler’s systems and facilities, and to the systems and facilities of those third parties to whom the Wheeler discloses information as described in this Policy.

INFORMATION THE WHEELER COLLECTS ABOUT YOU AND HOW THE WHEELER COLLECTS IT:

The Wheeler collects several types of information from and about users of the Wheeler Websites, including information:

  • By which you may be personally identified (referred to herein as “personal information”), such as name, postal address, email address, and telephone number; giving information (e.g., types and amounts of donations); information on events attended and publications received; and any other information provided by you to us that identifies you personally.
  • That is about you but individually does not identify you, including information that is anonymized, aggregated, or publicly available when not combined with non-publicly available information about you.
  • About your internet connection, the equipment you use to access the Wheeler’s Websites, and usage details.

We collect this information:

  • Directly from you when you provide it to the Wheeler’s Websites.
  • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.

Information You Provide to the Wheeler:

  • The information the Wheeler collects on or through the Wheeler’s websites may include: Information that you provide by filling in forms on the Wheeler’s websites. This includes information provided at the time of registering to use the Wheeler’s websites, completing a purchase through the Wheeler’s website or the Wheeler’s ticketing vendor’s platform, making a donation, or requesting further services.

The Wheeler may also ask you for information when you enter a contest or promotion sponsored by the Wheeler, and when you report a problem with the Wheeler Website’s.

  • Records and copies of your correspondence (including email addresses), if you contact the Wheeler via its websites.
  • Your responses to surveys that the Wheeler might ask you to complete for research purposes.
  • Details of transactions you carry out through the Wheeler’s websites and of the fulfillment of your orders. You may be required to provide financial information before placing an order through the Wheeler’s websites.
  • Your search queries on either of the Wheeler’s websites.
  • Information provided to process donations and event registration and issue tax receipts.
  • Information the Wheeler Collects through Automatic Data Collection Technologies as you navigate through and interact with the Wheeler’s websites, the Wheeler may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:
  • Details of your visits to the Wheeler’s websites, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Wheeler’s Websites.
  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

The information the Wheeler collects automatically may include personal information. It helps us to improve the Wheeler’s websites and to deliver a better and more personalized service, including by enabling the Wheeler to:

  • Estimate the Wheeler’s audience size and usage patterns.
  • Store information about your preferences, allowing the Wheeler to customize the Wheeler’s Websites according to your individual interests.
  • Speed up your searches.
  • Recognize when you return to either of the Wheeler’s websites.
  • Further fraud protection practices.

The technologies the Wheeler uses for this automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of the Wheeler’s websites. Unless you have adjusted your browser setting so that it will refuse cookies, the Wheeler’s system will issue cookies when you direct your browser to the Wheeler’s Websites.
  • Flash Cookies. Certain features of the Wheeler’s websites may use local stored objects to collect and store information about your preferences and navigation to, from, and on the Wheeler’s websites. Flash cookies are not managed by the same browser settings as are used for browser cookies.
  • Web Beacons. Pages of the Wheeler’s websites and the Wheeler’s e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Wheeler, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

PURPOSE FOR COLLECTING PERSONAL INFORMATION:

Your PII is collected for specified, legitimate purposes and not processed further in ways incompatible with those purposes. Collected PII is relevant to and not excessive for the purposes for which it is collected and used. The Wheeler may use your personal information for the following purposes:

  • Deliver and maintain the Wheeler’s products and services, including fulfilling orders and setting up accounts to provide the Wheeler’s products and services
  • Verify or authenticate your identity
  • Process donations and purchase transactions
  • Provide technical and customer support
  • Communicate with you about the Wheeler’s offerings, including sending newsletters and other marketing communications about current and future products and services, events, surveys and promotions
  • Building a safe and secure environment
  • Investigate and prevent security incidents
  • Providing a better user experience when you visit the Wheeler’s websites
  • Organize events or register attendees

HOW INFORMATION THE WHEELER COLLECTS IS DISCLOSED

Affiliate Communications and Third-Party Communications.

Unless you opt out, the Wheeler may share your PII with the Wheeler’s affiliates and other third parties, including venues, promoters or sponsors of events, artist representatives and fan clubs, and others who are involved in or help the Wheeler bring you events. When you buy tickets or products on the Wheeler’s Websites or sell tickets or bid in an auction for them if such services are available (or try to do these things), you consent to the Wheeler providing your PII to these third parties and their contractors. The Wheeler shares this information so these event providers and other parties may send you announcements and notifications of events, products or services that might be of interest to you, where permitted under applicable law. 

Service Providers

The Wheeler may contract with third-party service providers as data sub processors to collect or process your PII under the Wheeler’s instruction. Service providers can perform many processing activities including but not limited to ticketing services, administering services on the Wheeler’s behalf (e.g., email marketing, newsletters, or surveys), processing payment transactions), data analysis, and order fulfillment. These third-party service providers are bound by contractual obligations to keep PII confidential and use it only for the purpose for which it was disclosed to them.

OTHER PURPOSES

The Wheeler may also disclose your information:

  • In response to a subpoena or similar investigative demand, a court order, or a request for cooperation from law enforcement or another government agency;
  • to establish or exercise the Wheeler’s legal rights;
  • to defend against legal claims; and/or as otherwise required by law.

THIRD PARTY LINKS

The Wheeler’s websites may contain links to third-party Internet sites, which are not owned or operated by the Wheeler. The Wheeler provides such links only as a convenience, and the inclusion of a link on the Wheeler’s website does not imply endorsement of the linked site by us. If you provide any PII through any such third-party site, your transaction will occur on such third party’s site (not the Wheeler’s Websites) and the PII you provide will be collected by, and controlled by the privacy policy of, that third party. The Wheeler is not responsible for the privacy practices or the content of such third-party sites, including such sites’ use of any PII that you provide to them. The Wheeler strongly encourages you to become familiar with the privacy practices of those sites.
Your Privacy Rights

You control the information that you have provided to the Wheeler by way of the Websites. You may choose not to provide information through the Wheeler’s websites. If you have created an account, you may login to your account and correct and delete your information. If you’d like to delete your account entirely, please email the Wheeler at boxoffice@aspen.gov. To the extent that such information is stored in the Wheeler databases, the Wheeler will respond to your changes as soon as reasonably possible. Please note that although this information will not be available on the Wheeler’s Websites after you delete it, the information may remain stored indefinitely in the Wheeler’s backup and archival records for legal and accounting purposes to the extent permitted by law.

DATA RETENTION

We comply with all Internal Revenue Service, state, and local regulations governing the retention, management, and destruction of donor information collected and maintained by the Wheeler Opera House.

DATA SECURITY

The Wheeler employs reasonable security measures consistent with standard industry practice, for PII collected through the Wheeler’s Websites, including physical, electronic and operational measures to maintain security and prevent unauthorized access. While the Wheeler takes reasonable and appropriate steps to safeguard PII under the Wheelers control, unfortunately, no data transmission over the Internet or method of storing data can be guaranteed to be secure. As such, the Wheeler cannot guarantee that PII supplied by you will not be accessed on the Wheeler’s servers or intercepted while being transmitted to the Wheeler over the Internet. The Wheeler assumes no liability for any damages you may suffer as a result of interception, alteration or misuse of information during such transfers. If you have reason to believe that there has been any breach of the security of the Website, please contact us at boxoffice@aspen.gov. Pursuant to C.R.S. § 6-1-716, the Wheeler will notify users if it becomes aware of a security breach that resulted in the unauthorized release of protected personal information.

LIMITATION OF LIABILITY

TO THE EXTENT AUTHORIZED BY LAW IN NO EVENT WILL THE WHEELER OR THE WHEELER’S EVENT ORGANIZERS, SUPPLIERS, ADVERTISERS, AND SPONSORS, BE RESPONSIBLE OR LIABLE TO YOU OR ANYONE ELSE FOR, AND YOU HEREBY KNOWINGLY AND EXPRESSLY WAIVE ALL RIGHTS TO SEEK, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY TYPE, AND ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, ARISING OUT OF OR IN CONNECTION WITH THE WEBSITE, ANY CONTENT ON THE WEBSITES, OR ANY PRODUCT OR SERVICE PURCHASED THROUGH THE WEBSITE, EVEN IF THE WHEELER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF WHETHER THE CLAIM IS BASED UPON ANY CONTRACT, TORT, OR OTHER LEGAL OR EQUITABLE THEORY. WITHOUT LIMITING THE FOREGOING, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT THE WHEELER WILL HAVE NO LIABILITY OR RESPONSIBILITY WHATSOEVER FOR (a) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, WHETHER ARISING IN CONTRACT OR IN TORT, RESULTING FROM YOUR ACCESS TO AND USE OF THE WHEELER’S WEBSITES; (b) ANY UNAUTHORIZED ACCESS TO OR USE OF THE WHEELER’S SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN); (c) ANY BUGS, VIRUSES, WORMS, TROJAN HORSES, DEFECTS, DATE BOMBS, TIME BOMBS, OR OTHER ITEMS OF A DESTRUCTIVE NATURE WHICH MAY BE TRANSMITTED TO OR THROUGH THE WHEELER’S WEBSITE; OR (d) ANY LOST, STOLEN, OR DAMAGED TICKETS, OR THE FAILURE OF A VENUE TO HONOR A TICKET. YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE WEBSITE IS TO STOP USING THE WEBSITE. THE LIMITATIONS IN THIS SECTION WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THE ALLOCATION OF RISK BETWEEN THE WHEELER IS AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN THE WHEELER AND YOU THE PATRON. THE WHEELER IS OWNED AND OPERATED BY THE CITY OF ASPEN A HOME RULE MUNICIPALITY. NOTHING IN THIS POLICY SHALL BE DEEMED TO BE A WAVIER OF THE COLORADO GOVERNMENTAL IMMUNITY ACT ( CGIA) 24-10-101.

CHANGES TO THE WHEELER’S POLICY

It is the Wheeler’s policy to post any changes it makes to the Privacy Policy on this page. If The Wheeler makes material changes to how the Wheeler treats its users’ personal information, the Wheeler will notify you by email to the primary email address specified in your account or through a notice on the Website home page. The date the Policy was last revised is identified at the bottom of the page. You are responsible for ensuring the Wheeler has an up-to-date active and deliverable email address for you, and for periodically visiting the Wheeler’s website and this privacy policy to check for any changes.
